PacMe Corporation Privacy Policy

This privacy policy discloses the privacy practices for pacme.com. This privacy policy applies solely to information collected by this web site.

 

We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily give us via email, chat boxes, or other direct contact with you. We will not sell or rent this information to anyone.

 

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request (e.g. to ship an order).

 

Our primary way to contact you is through the chat boxes in your account.  This information is saved indefinitely so we will both have a record of our conversations.  Only people logged into your account can see these messages.

 

Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.

 

Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

 

Wherever we collect sensitive information (such as scans of your passport, driver’s license, or utility bill), such information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for "https" at the beginning of the address of the web page. Once received, we immediately remove it from any computer connected to the Internet.  In some instances, particularly in regards to the Postal Service PS-1583 form, we are required to store hard copies of these identity documents on our premises.

 

We do not store your complete credit card information on our servers or physical premises.  Your credit card information is stored at authorize.net, one of the largest and most secure credit card handlers in the world.  We do, however, store the last 4 digits of your card number and other partial pieces of information so that the card can be identified by you and us.

 

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

 

Registration
In order to use this website and our services, you must first complete a registration form. During registration, you are required to give certain information (such as your name, address, phone number, email address, and payment information). This information is used to contact you and set up your account so it can function properly.  You may also be asked to provide demographic information (such as gender or age) about yourself.  This information is used to verify your identity and protect you (i.e. the real you), us, and other customers from potential fraudulent activity.

 

Identity Verification
Some of our vendors, notably the US Postal Service, may require you to go through a significant identity verification procedure.  This may include providing your passport, utility bill, and other information to confirm your identity.  The PS-1583 form is required by the Postal Service for customers who have signed up for our “mail” service.  It’s also beneficial for “package-only” customers to have this form on file since many small packages arrive in mail envelopes.  Your signature on this form may need to be notarized by a Notary Public in your country.

 

We will also submit you to perhaps a lengthy identity verification procedure, similar to, or in conjunction with, the Post Office procedure.  Some countries (e.g. India, amongst others) now require us to “know thy customer” and obtain scans of documents, including passport, utility bill, phone bill, and/or driver’s license, which must accompany each shipment.

 

Sharing
We may share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.

 

We may partner with another party to provide specific services. When you sign up for these services, we will share your name and/or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

 

If it suspected that you are using your account for fraudulent purposes, we may need to share your information with the relevant authorities.

 

Orders & Shipments
On our consolidation and shipment forms, we request contact and financial information. This information is used for billing purposes and to fill your order. If we have trouble processing an order, we'll use this information to contact you.  Most likely, you will have already provided us this information in your account.  We will necessarily need to pass on the contact information to the carriers so they can deliver your package.

 

Cookies
We use "cookies" on this site. A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, it might also save your username and settings, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.

This web site contains links to other sites. We are not responsible for the content or privacy practices of such other sites. While the purpose of providing links is to assist you in quickly finding other sites, you do so at your own risk.

 

Surveys & Contests
From time-to-time our site requests information via surveys or contests.  Users of services provided by Pacme Corporation hereby agree to the following Terms and Conditions, officially located at https://pacme.com/faq/terms.

 

Users, including potential users, of services will be designated as "Users," “account,” or the pronoun "you." Pacme Corporation will be designated as "PacMe," forms of the pronoun "we," or "website."

 

PacMe reserves the right to modify these terms and conditions. It is the User's responsibility to review these Terms and Conditions periodically as continued use of PacMe's services will constitute the User’s acceptance of any revised Terms and Conditions.

 

Privacy Notice

Please see PacMe's Privacy Policy page to review it in detail. In general, we collect and store information that you input or upload to our website. This will include personally identifiable information, such as your name, address, phone number, and financial information. We also collect usage information. We will not sell or rent this information to third parties. We will, however, cooperate with law enforcement officials if there is reason to believe that your account is being used for fraudulent purposes. The User will be responsible for the expenses we incur dealing with any fraudulent activities.

 

Website Use

You agree to adhere to the following guidelines when using this Website:

  • You may not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • You may not publish, post, advertise, distribute, disseminate, or upload any defamatory, infringing, obscene, indecent or unlawful material or information.
  • You may not upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control all necessary rights to the files or have received all necessary consents.
  • You may not upload files that contain viruses, corrupted files, or any other similar software, code, or programs that may damage the operation of another's computer.
  • You may not delete or modify any author attributions, legal notices or proprietary designations or labels in any information that is published, posted, advertised, distributed, disseminated, or uploaded.
  • You may not falsify the origin or source of information or material published, posted, advertised, distributed, disseminated, or uploaded.
  • You may not conduct or forward surveys, contests, chain letters, or commercial solicitations.
  • You may not download any material or information published, posted, distributed, disseminated, or uploaded by another user that you know, or reasonably should know, cannot be legally distributed in such manner.
  • You may not provide personal information of others without their express permission.
  • You may not provide personal information of individuals under the age of 13.
  • You may not access or attempt to access PacMe’s information technology systems, environments, networks, files, data or accounts to which express authorization has not been obtained, or log into a server that you are not authorized to access.
  • You may not attempt to circumvent or subvert system or network security mechanisms, or probe the security of any system, network, or account associated or used in conjunction with this Website.
  • We would prefer that you do not post any personally identifiable information on publicly accessible areas of the Website. With respect to all information you elect to post to publicly accessible areas of the Website, you agree that PacMe has the right to use, reproduce, copy, modify, publish, distribute, perform and display such information (in whole or part) on a public basis; provided that such use is in accordance with the terms of PacMe’s Privacy Policy.

 

Use of Service

  • PacMe will provide the User with a mailbox number at our facility in the US for the purposes of receiving, storing, consolidating, and shipping the User’s online shopping packages.
  • The User is not allowed to use the address or mailbox number for any other purpose than that stated above, such as claiming it as a business or residence address. “Mail” customers can use the address as their “mailing address” for general mail, including as the “billing address” for their credit cards.
  • PacMe acts as an agent of the User when receiving and shipping packages. Unaffiliated carriers and providers (e.g. UPS, FedEx, DHL, and USPS) drop off, pick up, and deliver the packages.
  • All packages received by PacMe will be opened upon arrival.
  • The User is responsible for complying with the terms of sale imposed by the seller of the merchandise, including providing any necessary export paperwork.
  • Prohibited or restricted merchandise is not storable and will be rejected, forfeited, destroyed, or given to government officials.
  • PacMe carries catastrophic insurance (e.g. fire insurance) for all the items in our warehouse, but we are not responsible for the condition of individual packages or items. We check for damage upon receiving packages, however, and will assist you in returning damaged merchandise to the sender. Given the difficulty of the returns and claims process, we strongly advise not to purchase items that can be easily damaged.
  • Outbound shipping insurance can be purchased through PacMe, but the User is responsible for understanding the carrier’s (e.g. UPS, FedEx, DHL, and USPS) claims process and must deal directly with them. Insured value cannot exceed customs value.
  • The User authorizes PacMe to charge the User’s payment method for all previously provided, or eminent services. PacMe services and fees are clearly marked when they are selected by the User, or are listed on the website’s “Services and Fees” page.
  • Users are responsible for all import obligations in the destination country, including abiding by import restrictions and paying taxes, customs duties, and importation processing expenses.
  • If the outgoing shipment from PacMe to the User is returned to PacMe, the User is responsible for paying for all expenses associated with the return, including transport and processing fees. Most countries will not allow packages to be simply abandoned. They are returned to the sender and this cost must be paid by the User.
  • Either party may cancel a User’s account. There are no refunds for the annual fee, but a User’s Virtual Account balance, if any, can be returned after all fees are paid. Accounts that are past due are put on-hold and must be “paid up” before reactivating (see the FAQ).

 

General Compliance

  • The User is responsible for and warrants his/her compliance with all applicable laws, rules and regulations, including, but not limited to, the import and export laws and government regulations of any country to, from, through or over which the User’s shipment may be carried. This responsibility includes determining and meeting any and all applicable import and export obligations and license requirements, including those of the U.S. Department of Commerce, U.S. Department of State, U.S. Customs and Border Protection, U.S. Department of Treasury, and any and all import obligations or license requirements of the destination country.
  • The User agrees and acknowledges that he/she shall purchase any and all merchandise from United States sellers under an ex-works agreement.
  • The User acknowledges that PacMe will not directly or indirectly, participate in any way in any transaction involving any commodity, software or technology exported or to be exported from the United States that is subject to the International Trade in Arms Regulations (ITAR) or that would require an export license under the Export Administration Regulations (EAR). The User also acknowledges that PacMe does not allow for the use of license exceptions under the EAR or exemptions under the ITAR.
  • The User agrees to furnish the necessary information and complete and attach the necessary documents to comply with any applicable laws, rules and/or regulations, including notifying the United States Principal Party In Interest (“USPPI”), as defined by the United States Foreign Trade Regulations, about the nature of the export in every transaction generated by the User. The User agrees to provide to PacMe all required information for export purposes from the USPPI, including without limitation the Export Control Classification Number and the USPPI's tax identification number (if an Electronic Export Information filing (“EEI”) via the Automated Export System (“AES”)) is required.
  • If the price paid for merchandise is not listed on the invoice provided by the merchant, or if no invoice is available, the User is responsible for providing PacMe with the true and accurate price that the User paid for the merchandise, if the User purchased it. In all circumstances, the User represents and certifies that any value provided to PacMe is true and accurate. The PacMe Compliance Department reserves the right to periodically review values and may request additional documentation to support the values entered by the User. The User is subject to civil and criminal penalties for making false or fraudulent statements to the U.S. government or for the violation of any U.S. laws or regulations on exportation.
  • The User represents and warrants that (a) the recipient of any items consolidated by PacMe is the end user of any and all merchandise and mail that the User has requested be exported through a freight forwarder or carrier to the recipient’s address, or, if the User is reselling the merchandise, the User can identify the end users and provide PacMe with any requested information on such end users, (b) any and all merchandise and mail that the User requests be consolidated by PacMe will be used in the country to which the User requests shipment, and (c) the User will not re-export the merchandise and mail to a different destination. The User may not return to the United States or resell in or into the United States any food products or dietary supplements it receives through PacMe, and shall require any recipients of the food products or dietary supplements to adhere to the same requirements. PacMe reserves the right to request that the User or the recipient of an item, as applicable, sign documents confirming the end use or end user of any item exported through a freight forwarder or carrier by PacMe.
  • The User is responsible for confirming that prohibited items listed in the PacMe Compliance Policy are not sent to PacMe. See FAQ: Prohibited Goods for more information.
  • PacMe reserves the right to return packages to the sender(s) for any reason, to provide packages (and information concerning the same) to government authorities, or to otherwise discard packages.
  • The User represents and warrants that he/she will comply with all known applicable export and import control laws and regulations in the order and receipt of merchandise and mail under the terms of this Agreement.
  • The User represents and warrants that all its activities will be conducted in compliance with applicable laws governing the export, import, and provision of goods and services in the United States and in the jurisdictions in which the User resides, operates, or will receive shipments, including but not limited to the Laws of the United States governing embargoes, sanctions, and boycotts, the Arms Export Controls Act (22 U.S.C. 2778), the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), the Export Administration Act of 1979 (50 U.S.C. app. 2401-2420), the International Traffic in Arms Regulations (22 C.F.R. 120 et seq.), the Export Administration Regulations (15 C.F.R. 730 et. seq.), the Foreign Trade Regulations (15 C.F.R. Part 30) and all rules, regulations and executive orders relating to any of the foregoing, the Laws administered by the Office of Foreign Assets Controls of the United States Department of the Treasury, the Laws administered by United States Customs and Border Protection, and the Laws administered by the Bureau of Alcohol, Tobacco, Firearms, and Explosives of the U.S. Department of Justice (collectively "Export, Import, and Economic Sanctions Laws").
  • At no time shall the User provide merchandise or mail to any Prohibited Person (as defined herein). For purposes of this Agreement, a “Prohibited Person” shall mean (a) a Person who is a “designated national,” “specially designated national,” “specially designated terrorist,” “specially designated global terrorist,” “foreign terrorist organization,” “specially designated narcotics trafficker,” or “blocked person” within the definitions set forth in the Foreign Assets Control Regulations of the United States Treasury Department, 31 C.F.R., Subtitle B, Chapter V, as amended (the “OFAC Regulations”) or who otherwise appears on the list of Specially Designated Nationals and Blocked Persons, Appendix A to the OFAC Regulations; (b) the Government of Cuba, Iran, or Sudan, including any political subdivision, agency, or instrumentality thereof, or any other country against which the United States maintains economic sanctions or embargos under the OFAC Regulations or Executive Order; (c) a Person acting or purporting to act, directly or indirectly, on behalf of, or an entity owned or controlled by, any government, individual, or group against which the United States maintains economic sanctions or embargoes under the OFAC Regulations or Executive Order; (d) a Person who is described in section 1 of Executive Order 13224 – Blocking Property and Prohibiting Transactions with Persons who Commit, Threaten to Commit, or Support Terrorism, effective September 24, 2001; (e) a Person on any other list of terrorists or terrorist organizations maintained pursuant to any of the rules or regulations of OFAC or pursuant to any other Executive Order; or (F) a Person in violation of any other law, regulation, or Executive Order of similar import, as each such law has been or may be amended, adjusted, or modified or reviewed from time to time. In the event that the User is believed potentially to be a Prohibited Person or requests that PacMe arrange for the shipment of items to an individual or entity believed to be a Prohibited Person, PacMe may ask the User to provide documentation to show that the User and/or individual or entity to which a request to export items has been made is not a Prohibited Person. If the identity of the User and/or the individual or entity to which a request to export items has been made cannot be proven to the satisfaction of PacMe, PacMe reserves the right to remove the shipping address of such potential Prohibited Persons from the User’s account or to cancel the User’s account, PacMe also reserves the right to request a signed Statement of Assurance from the User stating that the User understands his or her obligations under U.S. export law and that the User will conduct screening to ensure that the User does not export to Prohibited Persons using the services of PacMe or its unaffiliated freight forwarders and/or carriers.

 

Appointment of PacMe as the User’s agent

  • As a User, you grant PacMe a “Limited” Power of Attorney to act as your agent for the following specific purposes: preparation of shipping documents; preparation of any Certificates of Origin; preparation of an EEI via AES and preparation of an airway bill or any other document required to export merchandise to User.
  • If an EEI (for which a preparation charge will apply) is required for goods manufactured and originating within the United States, PacMe will file the required export information on behalf of the User as its agent pursuant to this section. If the User or the USPPI fails to provide all of the information needed to accurately file an EEI, PacMe will decline to process the merchandise for export. PacMe reserves the right to review the accuracy of any information (e.g., by confirming that the Export Control Classification Number or merchandise value provided is correct). Under such circumstances, the User is responsible for all costs incurred in returning the merchandise, tendering the merchandise to government authorities, or forfeiting and/or destroying the merchandise. The User also acknowledges that under such circumstances, PacMe will not reimburse the User for the value of the merchandise.
  • The User acknowledges that he/she has a duty to – and is solely liable for – accurately providing all information required by United States' laws and regulations, including information required by 15 CFR § 30 and maintaining all records as required under law. Civil or criminal penalties may be imposed against the User by the U.S. government for making false or fraudulent statements with respect to this information.
  • PacMe assumes no responsibility to act as a record-keeper or record-keeping agent for either the User or the USPPI. The User is responsible to supply to PacMe all information regarding the USPPI, including its name and employer identification number (EIN), and the Export Control Classification Number (“ECCN”), Schedule B classification, and all other information required under a routed export transaction as described in Title 15, Code of Federal Regulations, Part 30, the Foreign Trade Regulations (FTR). The User also is responsible for providing the above information for any third-party seller listing items for sale on websites or through service providers like Amazon.com or eBay.com.

 

Indemnification

The User agrees that he/she will remain liable for and indemnify, defend, and hold harmless PacMe and its shareholders, officers, directors, agents, partners, employees and independent contractors, at all times from the date hereof, from and against any and all claims, actions, damages, awards, liabilities, losses (including consequential losses), judgments, penalties, interest, fines, expenses, and/or other costs (including attorneys' charges and court costs) arising by reason of the execution hereof or the consummation of the transactions contemplated hereby, including without limitation those arising from or relating to:

  • any negligent action or omission of User or any of the User's employees, contractors, agents or any other person acting under User's supervision or control prior to, as of, or following the date hereof;
  • any inaccuracy or breach of any representation or warranty made by User in this Agreement or any other document or instrument executed or delivered by User in connection with this Agreement;
  • any breach or non-performance of any covenant or agreement made by PacMe in this Agreement or any other document or instrument made by User in connection with this Agreement;
  • PacMe's preparation, determination or execution of the documents or any other document necessary for transportation, including but not limited to preparing address information, routing, classification, licensing requirements, and listing the value of goods or the value for carriage, except for claims arising solely from the gross negligence or willful misconduct of PacMe;
  • the User providing to PacMe any incomplete or false information; and
  • the User's failure to comply with the terms hereof or of any jurisdiction's law applicable to the exportation or importation of such shipments.

The User acknowledges that the foregoing provisions are a material inducement for PacMe to enter into this Agreement and the transactions contemplated hereby, and shall survive termination of this Agreement.

 

Severability

Any use in contravention of this provision or any provision of this Agreement is at your own risk and, if any part of this Agreement is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall govern such use.

 

No Legal Relationship

You agree that no joint venture, partnership, employment, or agency relationship exists between you and PacMe as a result of this Agreement or your use of this website.

 

Entire Agreement

This Agreement constitutes the entire agreement between you and PacMe with respect to this Website. This Agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and PacMe with respect to this Website. Any alleged waiver of any breach of this Agreement shall not be deemed to be a waiver of any future breach.

 

Conflict of Laws

This Agreement and all disputes concerning this Agreement shall be governed by the applicable law and the applicable regulations of the United States and by the applicable regulations of any agency of the United States, without applying conflict of law principles that would result in applying any state law or state regulation other than those of Oregon. The parties, in all disputes between them, consent and submit to the exclusive jurisdiction and the exclusive venue of the United States courts and the parties waive all claims that such jurisdiction and venue is improper or inconvenient. In all lawsuits to enforce or interpret this Agreement, the parties waive all rights to a jury trial, and in such actions the prevailing party shall recover from the other party the prevailing party's costs and expenses, including the prevailing party's attorneys, experts and consultants. Notwithstanding the foregoing jurisdiction, and venue restrictions, the party in whose favor a judgment with respect to this agreement is entered shall be entitled to enforce that judgment in any jurisdiction in any venue.
